- A variety should be new: it should not have been commercialized for one year before the application date in the country of protection.
- A variety should be distinctive: botanical differences should be evident, such as height, maturity, color, etc., which sets it apart from other already known varieties. A variety needs to have uniformity: the characteristic traits of the variety must be found in all the plants of the variety.
- A variety needs to have stable traits: the characteristic traits of the plants need to be the result of genetics and not caused by dependent variables such as soil conditions or being grown in greenhouses. Consequently the characteristic traits continue to be the same generation after generation or, in the case of hybrids, after numerous cycles of reproduction.
And finally, one should name the variety with a name that will be recognizable in every part of the planet.
